Terms of Service ("Terms")

1. Overview

Please read these Terms carefully before using the https://stillmaps.com website ("Stillmaps", the "Platform").

Your access to and use of the Platform is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Platform.

By accessing or using the Platform you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Platform.

Stillmaps is a web-based honor and shared history platform that allows users to create digital parks, place digital monuments, and interact through digital tributes, intended for expression, recognition, and participation.

The Platform does not provide financial products, investment instruments, securities, tokenized assets, or digital financial assets. No content, digital object, or interaction available on the Platform represents:

  • ownership of real-world assets
  • tokenized securities or treasuries
  • investment contracts
  • promises of financial return

All features are provided for expressive and symbolic purposes only.

2. Eligibility

You must be at least 18 years old to use the Platform.

By using the Platform, you confirm that you have the legal capacity to enter into these Terms.

3. Map Canvas (or "Map")

A Map Canvas is an empty digital space that a user may purchase on the Platform. For each Map Canvas, the Platform sets activation prices for the supported activation types (such as private and/or public).

Activation prices and supported activation types are shown to the user prior to activation as well as the Map’s size and layout limitations.

These limitations include the available area and the maximum number and types of Monument Slots that can be placed on the Map, and cannot be expanded after activation.

A Map Canvas:

  • initially contains no predefined honor, historical meaning, or commemorative content
  • serves as a creative environment for placing visual elements, objects, and slots
  • is defined primarily by its size and layout boundaries

Purchasing a Map Canvas grants access to a digital environment and creative tools only.

4. Park

A Park is a Map Canvas that has been configured by a user through the placement of objects, Monument Slots, and settings for access and participation.

A Park may include:

  • landscape elements (paths, vegetation, water, structures)
  • one or more Monument Slots
  • descriptive information such as a title, cover image, and description

A Park is a digital environment and does not represent a physical location or real-world property.

Parks may exist in different operational states, including draft, private, and public:

  • Draft Parks are accessible only to their creator and cannot accept purchases, monuments, or public access.
  • Private Parks may allow view-only access but do not support slot purchases by other users.
  • Public Parks enable slot purchases and monument placement by eligible users. Once a Park is public, its map layout may be locked to protect purchased Slots.

The availability of features depends on the Park's current state. The operational state of a Park (draft, private, or public) is determined by the activation type of the underlying Map Canvas.

5. Monument Slot (or "Slot")

A Monument Slot is a designated location within a Park where a Monument may be placed.

Map Canvas owners independently decide:

  • how many Slots to place on a Map (subject to Map limitations)
  • the size and placement of each slot (subject to Map limitations)
  • whether slots are paid or free

The existence, availability, or pricing of a Monument Slot reflects user-defined configuration choices.

6. Slot and Map Purchase Terms

Slots and Map Canvases are purchased as long-term commemorative placements without a predefined expiration date.

The Platform does not guarantee perpetual availability, uninterrupted service, or indefinite storage of any Map, Slot, Park, or Monument.

The term "lifetime" or similar expressions, when used in connection with Slots or Maps, refer solely to the symbolic intent of commemoration.

The Platform may modify, suspend, or discontinue parts of the service, including storage or access to digital content, without assuming long-term or perpetual obligations.

7. Monument

A Monument is a symbolic digital representation of a specific individual, placed to an available Monument Slot within a Park.

A Monument may include:

  • a name
  • photographs
  • biographical information
  • genealogical or relational connections to other Monuments

Monuments are non-physical and exist solely within the Platform environment. They do not represent ownership of physical assets, real-world monuments, or property rights outside the Platform.

Where a Monument indicates that an individual is deceased (including by specifying a date of death), the Platform reserves the right to request reasonable confirmation of death (such as a death certificate or public obituary) in cases of doubt, dispute, or reported violations.

8. Digital Object Status (General)

Monuments, Monument Slots, and Parks are digital-only, non-transferable, non-inheritable, and do not constitute property, ownership rights, or transferable digital assets unless explicitly stated otherwise by the Platform.

Ownership of a Monument Slot is assigned to the user who purchases or claims the Slot, subject to the Park's current state.

Removing or deleting a Monument does not automatically release or reassign the associated Slot. Slot resale or reassignment is not supported unless explicitly enabled by the Platform.

9. Slot Pricing

Map owners may assign any price to Slots, including zero.

Slot prices reflect symbolic, personal, or honorary or honorary value only.

The Platform may display informational notices explaining how different configurations influence activity signals, without guaranteeing any outcomes. Such informational notices are provided for transparency only and do not constitute guidance, predictions, or financial advice.

10. Map Pricing and Fees

Map Canvases are offered at prices displayed to the user prior to activation.

Prices may vary depending on the selected configuration, the user's region, and the applicable payment method, and may be presented in different currencies or internal platform units.

Prices for Monument Slots are set independently by Map owners. The Platform does not control or guarantee slot pricing established by users.

The Platform reserves the right to update, modify, or adjust prices, fees, or available configurations at any time. Such changes do not affect purchases already completed.

11. Digital Items & Paid Interactions

Users may purchase digital items or interactions, including but not limited to:

  • digital flowers
  • commemorative elements
  • symbolic enhancements

All purchases relate solely to digital content and experiences within the Platform.

Depending on the user's region, payment method, and applicable legal, technical, or operational requirements, the Platform may offer paid interactions either:

  • through the use of internal platform units, credits, or symbolic values, or
  • through direct currency-denominated payments.

Internal platform units, where used, do not represent currency and may only be used within the Platform to access digital content or interactions.

12. Tribute Messages and Wishes

Tribute messages, wishes, and symbolic interactions associated with Monuments or Parks must be respectful and commemorative in nature.

The following content is prohibited:

  • advertising or promotional messages
  • political, ideological, or religious calls to action
  • fundraising requests
  • external commercial links or solicitations

The Platform reserves the right to remove or restrict tribute content that violates these rules.

13. Contribution Points

The Platform may issue contribution points as an internal, non-monetary metric reflecting activity and engagement, including:

  • placement or purchase of slots
  • interactions with existing Parks (such as tributes or symbolic actions)

Contribution points:

  • are not money
  • are not balances
  • do not guarantee any financial reward or payout

For the purposes of the Platform, "Contribution Points" may be displayed in the user interface as "Rewards" and represented by star icons. Such representation is purely visual and does not affect the legal nature of Contribution Points as described herein.

Contribution Points may be awarded for paid actions on the Platform regardless of the source of funds used for such actions, including real payments, promotional credits, or other internal balances.

14. Referral Credits

The Platform may offer a referral program that grants users internal referral credits for inviting new users to the Platform.

Referral credits may be issued only in connection with qualifying paid actions performed by the referred user (such as adding funds or purchasing paid items), as defined by the Platform at its sole discretion.

Referral credits:

  • are issued as internal, promotional platform credits
  • are not rewards, contribution points, income, compensation, or financial instruments
  • are not withdrawable, refundable, or exchangeable for cash
  • may be used solely to purchase digital items or services within the Platform, including Map Canvases and Monument Slots

Referral credits have no value outside the Platform and may not be transferred between users unless explicitly allowed by the Platform.

The Platform reserves the right to modify, limit, suspend, or discontinue the referral program or referral credit balances at any time, at its sole discretion.

15. Affiliate and Partner Marketing

The Platform may collaborate with third-party partners, affiliates, or publishers ("Partners") who refer users to the Platform.

15.1 Attribution and Tracking

When you visit the Platform via a Partner link, the Platform may capture and store limited attribution information (e.g., a click identifier, referral identifier, and/or campaign parameters such as UTM tags) to:

  • measure marketing effectiveness
  • prevent fraud and abuse
  • reconcile Partner performance

Attribution is calculated on an "as-is" basis using the Platform's internal rules (for example, a last-click model within a limited attribution window). The Platform may update attribution rules from time to time.

15.2 What We Share with Partners

To verify performance, we may share with a Partner limited conversion data linked to the Partner's click identifier, such as event type (e.g., sign-up, activation, purchase) and associated value (if any). We do not share account credentials. We do not share personal content from memorials. Any additional sharing requires a separate agreement and/or a legal basis under applicable law.

15.3 Prohibited Partner Traffic

Partners must not:

  • misrepresent the Platform or use deceptive advertising
  • use spam, unsolicited messages, or misleading landing pages
  • interfere with or bypass Platform security or technical measures
  • generate fraudulent, incentivized, or non-genuine registrations/purchases unless explicitly permitted in writing by the Platform

The Platform may withhold or invalidate attributed actions that reasonably appear fraudulent, abusive, or in violation of these Terms.

15.4 Partner Payments

Any Partner compensation (if offered) is governed solely by a separate written agreement with the Platform. The Platform does not provide automatic payouts by default. Unless required by applicable law or explicitly agreed in writing, Partner compensation is not guaranteed.

16. Content and Conduct

Parks must be treated with dignity. Harassment, mockery, or provocation is prohibited.

Users may submit content including text, images, or symbolic representations.

By submitting content, you grant the Platform a non-exclusive, worldwide license to display such content solely for operating the service.

You remain responsible for the content you publish.

By uploading any images or visual content, you confirm that you own the rights to such content or have obtained all necessary permissions, licenses, or consents to upload and display it on the Platform, including consent from depicted individuals or their lawful representatives where required.

17. Monument and Park Content Rules

Names, descriptions, images, and other content associated with Maps, Parks, or Monuments must not:

  • contain commercial offers, advertisements, or promotional content
  • reference brands, trademarks, or copyrighted entities without authorization from their owners
  • reference, depict, or impersonate real individuals (living or deceased) without having the necessary rights, permissions, or lawful basis to do so
  • include misleading, defamatory, or unlawful information

17.1 User-Generated Visual Assets (Custom Tiles and Artwork)

Users may upload custom visual assets, including tiles, textures, or artwork, for use within their Maps or Parks ("Custom Visual Assets").

By uploading Custom Visual Assets, you represent and warrant that:

  • you own all necessary rights to the uploaded content, or
  • you have obtained all required permissions, licenses, or consents to use and upload such content.

Custom Visual Assets must not:

  • infringe copyrights, trademarks, or other intellectual property rights of third parties
  • include offensive, unlawful, or inappropriate imagery
  • misrepresent real-world individuals, brands, or protected works without authorization

The Platform may review, restrict, remove, or disable Custom Visual Assets at its discretion, including for legal, ethical, technical, or moderation reasons.

Uploading Custom Visual Assets does not transfer ownership of such assets to the Platform. However, by uploading content, you grant the Platform a non-exclusive, worldwide, royalty-free license to store, process, display, and distribute the content solely for operating and providing the Platform's services.

17.2 Photographs of Real People

Photographs of real people may only be uploaded if the user has the legal right to use and display such images on the Platform. This includes obtaining consent where required by applicable privacy or publicity laws.

The Platform does not verify whether a depicted individual is a public figure, private individual, or otherwise known, and relies on user representations regarding rights and permissions.

The creator of a Park or Monument bears full responsibility for the accuracy, legality, and permissibility of all published information.

18. Prohibited Content

You agree not to:

  • publish hateful, extremist, or violent content
  • impersonate real individuals without authorization
  • upload content that is unlawful, misleading, or offensive
  • use the Platform for harassment, provocation, or abuse
  • misuse Parks in a disrespectful manner

19. Content Moderation

The Platform reserves the right to:

  • review user content
  • remove or restrict content that violates these Terms
  • suspend or terminate accounts in case of repeated or severe violations

Moderation decisions are made to preserve respectful and safe use of Parks.

Repeated or severe violations of content or conduct rules may result in account suspension or termination, including loss of access to created Parks, Slots, and Monuments, without compensation.

The Platform is not obligated to preserve access to or availability of content created in violation of these Terms.

In addition to removing or restricting specific content, the Platform may restrict or disable editing capabilities for a Park (including by placing it in a “Locked” state) where the Platform reasonably believes such action is necessary to prevent abuse, misuse, or harm to other users or the Platform. Such measures may be applied without removing the Park and without affecting the continued existence or symbolic value of the Park, its Monuments, or associated Slots.

20. Refunds

Digital items are generally non-refundable, except where required by applicable law.

Upon account deletion, any unused internal balances, including referral credits, promotional credits, or similar internal values, are forfeited and are not refundable, transferable, or redeemable for cash, except where required by applicable law.

21. Ethical and Cultural Considerations

The Platform is intended for honorary, historical, and symbolic purposes and is used by people from different cultures, traditions, and belief systems.

We recognize that approaches to memory, remembrance, symbolism, and commemorative practices may vary across cultures and personal beliefs. Our goal is to maintain a culturally neutral, respectful, and inclusive environment.

In this context, the Platform reserves the right, at its discretion, to:

  • modify, replace, or adjust the visual appearance of monuments, offerings, and commemorative elements
  • restrict or remove user-submitted visual content
  • update available visual styles or symbolic elements

Such actions may be taken to preserve cultural sensitivity, ethical considerations, platform integrity, or a respectful Park environment.

These measures do not imply endorsement or rejection of any specific cultural, religious, or ideological views.

Nothing in this section creates a legal obligation to modify specific content or features. Ethical review and related actions are conducted at the Platform's discretion.

22. Service Availability

The Platform is provided on an "as is" and "as available" basis.

We do not guarantee uninterrupted availability.

23. Limitation of Liability

To the maximum extent permitted by law, the Platform shall not be liable for:

  • emotional distress resulting from user-generated content
  • indirect or consequential damages
  • user-generated content
  • loss of data or access

24. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.
